NBy registering and/or using the services of goc-pay.com, the User automatically agrees to all the terms of service of goc-pay. These Terms of Use govern the use of all services provided on the goc-pay.com system and apply to all Users and any parties submitting requests or information to goc-pay.com. By registering an account on goc-pay.com and/or using the goc-pay.com system, the User is deemed to have read, understood, and agreed to all the contents of these Terms of Use.

We may change, modify, add, delete, or correct ("changes") these Terms of Use at any time in line with the development of goc-pay.com and legal regulations. Users are encouraged to visit the goc-pay.com system periodically to be aware of any changes.

THESE TERMS OF USE CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN THE USER AND GOCpay. USERS CONSCIOUSLY AND VOLUNTARILY AGREE TO THESE TERMS TO USE THE SERVICES IN THE GOC-PAY.COM SYSTEM.

Definitions

In these Terms of Use, unless otherwise specified, the following terms have the meanings set out below:

• Account: Data about the User, consisting at a minimum of username, password, phone number, and email that must be filled in by the Registered User.
• Terms of Use: An agreement between the User and GOCpay containing a set of rules that govern the rights, obligations, responsibilities of the User and GOCpay, as well as procedures for using the service system on goc-pay.com.
• GOC-pay.com Payment System: A payment system facilitated by GOCpay for Users to conduct transactions on the goc-pay.com system.
• Personal Data / Information: Data related to the User that can be identified and/or identifiable individually or in combination with other information, either directly or indirectly through electronic and/or non-electronic systems.
• Service: Collectively: (i) the goc-pay.com System; (ii) any content, features, services, and functions available on or through the System by or on behalf of goc-pay.com, including Partner services; and email notifications, buttons, widgets, promotions, and advertisements including goc-pay.com's cooperation with third parties for application development and business development activities of goc-pay.com.
• Partner: Parties that cooperate with GOCpay to support the goc-pay.com system and services, such as payment service providers, voucher providers, network providers, etc.
• User: Parties (registered/non-registered) who access the goc-pay.com system, including but not limited to buyers, offline users, clients who must comply with the goc-pay.com Terms of Use and other provisions including but not limited to the goc-pay.com Privacy Policy.
• Buyer: A registered or non-registered User who conducts direct top-ups or purchases vouchers sold by the goc-pay.com system and must comply with the goc-pay.com Terms of Use and other provisions including but not limited to the goc-pay.com Privacy Policy.
• Goc-pay.com System: The official site www.goc-pay.com or other systems or means that can be accessed through the User's computer and/or mobile devices including Affiliates, third parties collaborating with goc-pay.com.

Services

Goc-pay.com manages and provides the System and Services for Users to make direct top-up purchases or buy vouchers sold by goc-pay.com. Upon making a top-up or voucher purchase in accordance with the goc-pay.com Terms of Use, the Buyer is responsible for the purchased top-up or voucher.

Goc-pay.com offers and manages a virtual product sales system where the products sold are direct top-ups or vouchers that can be used by the Buyer. Goc-pay.com is not responsible if you experience a loss in your business as a Buyer, such as negligence or order input errors.

Goc-pay.com does not accept requests for cancellations/refunds once an order has been entered into the goc-pay.com system. Goc-pay.com may provide refunds if the order cannot be completed as per the applicable terms.

Payment System

Goc-pay.com collaborates with official Payment System Service Providers (Banks and Non-Banks) monitored by Bank Indonesia and the Financial Services Authority to provide a payment system to facilitate and secure every transaction occurring on the goc-pay.com System for Users.

Payment Methods provided through the goc-pay.com System include:

• Bank Transfer
• In-store Payment (Offline Store Payment)
• Electronic Money
• User Wallet

Mandatory requirements for Users to access Services on goc-pay.com include:

• Users under the age of 18 must obtain parental or guardian consent to use and/or access Services on goc-pay.com and are responsible for any costs incurred related to the use of Services on goc-pay.com.
• Users must read, understand, and comply with all provisions set out in these Terms of Use.
• Users registering on goc-pay.com must fill in their personal data completely and honestly according to their personal identity.
• Users must provide true, clear, honest, accurate, complete, and up-to-date information about themselves for the use of goc-pay.com from time to time.
• Users must understand that their account information details are confidential and therefore must not disclose their account information details to any Third Party. Goc-pay.com will not ask for the User’s password. Users agree to bear any risks associated with the disclosure of their account information to any third party and take full responsibility for any consequences arising from it.
• Users are prohibited from using robots, spiders, processes, or means to access Services for any purpose, or any other automated devices, including but not limited to monitoring or copying any material on the System or Services on goc-pay.com.
• If a User reports and/or complains about the Services on goc-pay.com and/or the Terms of Use, every report and/or complaint must be made in good faith and with the intent to resolve the issue.
• Users are prohibited from using goc-pay.com to violate the laws applicable in Indonesia or other countries.
• While using and/or accessing any system or service of goc-pay.com, Users are strictly prohibited from uploading and/or using words, comments, images, or content that contains elements of ethnicity, religion, race, and intergroup (SARA), misleading, defamatory, discriminatory, degrading or belittling others, disturbing public order, causing unrest, disturbing public order, vulgar, threatening, offensive, or anything else that may be deemed inappropriate with social values and norms and contrary to the regulations or laws in force.
• Users are responsible for all risks that arise in the future for the information they provide to goc-pay.com, including but not limited to matters related to Intellectual Property Rights, such as copyrights, trademarks, patents, trade secrets, industrial designs, and integrated circuit layout designs of a product.
• Users must respect the rights of other Users by not providing personal information to others without the permission of the concerned party.
• Users are prohibited from sending spam messages in any form by referring to any features/services in the goc-pay.com System or Services for any purpose.
• Goc-pay.com reserves the right at any time without prior notice to Users to block the use of the system or services if Users violate the regulations in force in Indonesia.
• Users are prohibited from using the logo, images, appearance of goc-pay.com in User profile photos (avatars), NFTs (Non-Fungible Tokens), or for other personal purposes without prior approval from goc-pay.com.
• Users are prohibited from distributing viruses or other technologies that may harm goc-pay.com, the interests and/or properties of goc-pay.com Users, or Government institutions.
• If in the future violations related to the Terms of Use are found by Users, goc-pay.com reserves the right to take necessary actions to maintain the security and comfort of other Users and the goc-pay.com System.
• Users are fully responsible for all content that Users upload, email, send, and/or provide through the goc-pay.com System or services.
• Users hereby state that goc-pay.com is not responsible for losses or issues arising from the misuse of the User's account due to the User's negligence, including but not limited to lending or giving account access to others, accessing links provided by others, giving or showing passwords or emails to others, or other User negligence resulting in losses or issues with the User's account.
• Users hereby state that goc-pay.com is not responsible for losses or issues arising from User actions.
• For User security, goc-pay.com recommends that Users change their password periodically to maintain the confidentiality of their account.
• Users guarantee that the identity/personal data they register in creating a goc-pay.com account is their own identity/personal data and not someone else's.
• Users will cooperate with goc-pay.com to investigate and determine whether a violation of these Terms of Use has occurred by providing goc-pay.com (along with appointed parties and independent auditors) access to personal data and/or devices used by Users to access/open the goc-pay.com System. In this case, Users authorize goc-pay.com to cooperate with authorities (including but not limited to the police, government agencies, telecommunications service providers, internet network providers, data center service providers, and others) without prior approval from Users.
• Users guarantee not to take any action that may affect/decrease/disrupt the services, software, hardware, systems, networks used by other Users to access the goc-pay.com System.
• Users guarantee not to take any action that may disrupt and/or negatively impact goc-pay.com and cause detrimental effects to the continuity of goc-pay.com business activities.
• Users are prohibited from using goc-pay.com Services to impersonate someone/another party illegally to mislead and/or deceive others, either intentionally or unintentionally.
• Users are prohibited from using the goc-pay.com System with the intention of collecting Users' personal data to violate the Privacy Policy and applicable laws in Indonesia.
• In case of a violation of these Terms of Use or other goc-pay.com terms and conditions, goc-pay.com reserves the right to take necessary actions for such violations, including deleting content, blocking accounts, canceling transactions, refunding money, etc.
• Goc-pay.com Users must fill in their personal bank data for transaction purposes on goc-pay.com.
• Be cautious of fraud under the guise of goc-pay.com.

Transactions

Users must transact through the transaction procedures established by goc-pay.com. Buyers make payments using the payment method previously selected by the User in the goc-pay.com System. When making payments, Users do not disclose their data/information to anyone.

When making a purchase on the goc-pay.com System, Users agree that:

• Users are responsible for reading, understanding, and agreeing to the information and description of the entire product (including but not limited to quantity, value, use, function, etc.) before committing to purchasing the product.
• Users enter into a legally binding agreement for the purchase or payment of direct top-up or vouchers when Users transact a direct top-up or purchase a voucher.
• Users understand and agree that the availability of goods is the responsibility of the Partner. If the product stock is out, the Partner will reject the order, and the purchase payment will be refunded to the User.
• Users understand and agree that all transactions conducted outside the system or official transactions of goc-pay.com and/or without the knowledge of goc-pay.com (through private networks, message exchanges, purchases outside goc-pay.com, and/or purchases outside the invoice billed by goc-pay.com) are the personal responsibility of the User and not the responsibility of goc-pay.com.
• Users understand and agree not to submit/provide transaction proofs done on goc-pay.com to other parties except goc-pay.com through the official communication channel of goc-pay.com. In such cases, if a loss occurs due to submission or notification of transaction proofs to other parties, it is the responsibility of each Buyer.
• Users understand and agree that all claims submitted after the confirmation/automatic confirmation of receipt of goods are not the responsibility of goc-pay.com. Losses incurred after the confirmation/automatic confirmation of receipt of goods are the responsibility of each User.
• Users understand and agree that payment delays and additional fees caused by differences between the bank used by the User and the official goc-pay.com bank are the personal responsibility of the User.
• Users hereby agree and understand that goc-pay.com, at its discretion, may at any time impose additional fees for transactions in the goc-pay.com System.
• Users fully understand and agree that all transactions conducted between Users and goc-pay.com, other than through the Official goc-pay.com Account and/or without the knowledge of goc-pay.com (through private facilities/networks, message exchanges, special transaction arrangements outside the goc-pay.com System, or other efforts), are the personal responsibility of the User.
• Users must transfer the exact total transaction amount within the specified time in the goc-pay.com System. If the User does not transfer the funds within the specified time, the transaction will be automatically canceled.
• Every transaction on goc-pay.com that uses the transfer method will incur a service fee in the form of a unique payment code to facilitate the verification process. Goc-pay.com is not responsible for losses experienced by Users if they make payments that do not match the billing amount on the payment page.
• If Users conduct transactions unofficially or commit fraud, goc-pay.com has the right to take legal action.
• Users must be accountable for their mistakes or negligence.

Return, Refund, and Cancellation Policy

We do not accept returns except for errors on our part and outside the conditions stated in the terms and conditions on this page. Product returns that occur outside of the agreed purchase problem resolution are not our responsibility and are not part of our service. We are not responsible for items you return as these items legally become the property and responsibility of the Customer.

• Returns apply if the product (Game Voucher) has been checked by the GOCpay team and found to be in error.
• Order cancellations are canceled unilaterally if:
  1. You have not made a payment within 24 hours after the order or at the customer's request.
  2. We have not received your payment.
  3. The invoice date for the order has expired (applicable for GOC Wallet top-up/purchase of other products).

User Data

Users hereby agree that goc-pay.com can collect, use, access, store, and/or process User data, including but not limited to personal information, conversation content, and/or information about service usage by Users on the goc-pay.com System. To the extent permitted by applicable law, goc-pay.com (including affiliated companies and official partners cooperating with goc-pay.com) reserves the right to use all or part of the data obtained and collected from Users through the goc-pay.com System for the purposes of developing and improving quality for User security and comfort. Details regarding User data are listed in the goc-pay.com Privacy Policy. Goc-pay.com reserves the right to disclose User data for legal processes and/or requests from government agencies, law enforcement, and other official authorities as stipulated by applicable laws in Indonesia.

Promotions

Goc-pay.com may hold promotions from time to time with terms and conditions set by goc-pay.com. The terms and conditions may vary for each promotional activity. Users must read and understand the terms and conditions of each promotional activity from time to time. Goc-pay.com reserves the right to cancel transactions related to promotions at any time without prior notice for the comfort and safety of other Users. Goc-pay.com reserves the right to change the terms and conditions of each promotional activity held by goc-pay.com from time to time without prior notice to Users.

Governing Law and Dispute Resolution

This agreement will be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of laws principles. Users agree that any legal action or dispute arising from, related to, or in any way connected with the goc-pay.com System and Services and/or these Terms of Use will be resolved exclusively through BANI (Badan Arbitrase Nasional Indonesia) established on November 30, 1977, based on the Decision of the Indonesian Chamber of Commerce No. SKEP/152/DPH/1977, whose rules are deemed incorporated into these provisions.

Indemnification

Users agree to release goc-pay.com from indemnity claims and to keep goc-pay.com (including affiliated companies, directors, commissioners, officers, and all employees and agents) free from any claims or demands, liabilities, losses, and reasonable legal costs, made by Third Parties arising from User errors, including but not limited to violations of these Terms of Use, improper use of goc-pay.com Services in the goc-pay.com System, infringement of third party rights, violations of the goc-pay.com Privacy Policy, and/or violations of applicable laws in the Republic of Indonesia.

Termination/Modification of Services and Third-Party Services

Goc-pay.com (including affiliated companies, directors, commissioners, officers, and all employees and agents) is not responsible, and Users agree not to hold goc-pay.com responsible for any damages or losses (including but not limited to loss of money, reputation, profits, or intangible losses) directly or indirectly caused by the use of third-party services accessed by Users through the goc-pay.com System. Users are advised to carefully read the terms of use and other conditions provided by each third party. Goc-pay.com reserves the right to modify/terminate/suspend services and/or third-party services without User consent/notification.

Warranty Disclaimer and Limitation of Liability

GOCpay will continually strive to maintain the quality of goc-pay.com services to remain safe, comfortable, and functional, but goc-pay.com cannot guarantee continuous operation or access to the goc-pay.com System will always be perfect. Information and data in the goc-pay.com System may not occur in real-time. If Users have a dispute with one or more other Users, Users release goc-pay.com (including parent companies, affiliates, commissioners, directors, and/or employees) from claims and demands for damages and losses (actual and implied) of any kind and nature, arising from or in any way related to the dispute. Therefore, Users intentionally waive all legal protections (contained in laws or other legal regulations) that will limit the scope of this release provision. Users agree and acknowledge that they use goc-pay.com Services in the goc-pay.com System at their own risk, and goc-pay.com Services are provided to Users as-is and as-available. To the extent permitted by applicable law, goc-pay.com (including affiliated companies, directors, commissioners, officers, and all employees and agents) is not responsible, and Users agree not to hold goc-pay.com responsible for any damages or losses (including but not limited to loss of money, reputation, profits, or intangible losses) directly or indirectly caused by:

• Use or inability to use the goc-pay.com System
• Prices, quantity, or other instructions available in the goc-pay.com System
• Delays or disruptions in goc-pay.com Services
• Negligence and losses caused by each User
• Disputes between Users
• Defamation of others
• Misuse of products available on the goc-pay.com System that have been purchased by Users
• Losses due to unofficial payments to other parties besides the official goc-pay.com account in any way on behalf of goc-pay.com or negligence in writing the account number and/or other information and/or bank party negligence
• Viruses or other harmful software (bots, scripts, other automation tools) obtained by accessing or connecting to goc-pay.com Services
• Interruptions, bugs, errors, or inaccuracies in goc-pay.com Services
• Damage to User hardware from using any Service in the goc-pay.com System
• Hacking actions by third parties on User accounts
• Failures and/or disruptions in implementing new technology and/or systems on facilities, devices, and/or internet networks owned and/or experienced by Users
• Network disruptions in goc-pay.com resulting in server downtime and requiring emergency maintenance and/or repair of the goc-pay.com System
• Misuse of User accounts due to User negligence, including but not limited to lending accounts to others, providing password access to others, giving authentication codes to others, accessing links from others, or other User negligence resulting in losses or issues for Users
• Unavailability of Services in the goc-pay.com System at any time or for an indefinite period due to matters beyond goc-pay.com's control

Updates and Modifications to Terms of Use

Goc-pay.com has the right to update and/or change the Terms of Use from time to time if necessary for the safety and comfort of User transactions in the goc-pay.com System. Users agree that they are responsible for reading carefully and checking these Terms of Use from time to time to be aware of any updates and/or changes. By continuing to access and use the Services in the goc-pay.com System, Users are deemed to agree to the updates and/or changes to these Terms of Use.
